Lucknow: Sacked police constable convicted in 2018 murder of Apple manager Vivek Tiwari

Lucknow, Sep 17 (UNI) A Lucknow court has convicted dismissed police constable Prashant Choudhary in the eight-year-old murder of Apple manager Vivek Tiwari in the Gomti Nagar area.
In its verdict delivered on Thursday, the Lucknow court found Prashant Choudhary guilty of culpable homicide.
However another constable, Sandeep Kumar, was acquitted due to lack of evidence.
The court will announce the quantum of punishment on September 21.
District and sessions judge Malkhan Singh delivered the judgment in the case, registered as Sessions Trial No. 49 of 2019, State vs Prashant Kumar Chaudhary, at Gomti Nagar police station.
The case relates to offences under sections 302 and 323 of the Indian Penal Code.
Meanwhile, the victim Vivek's wife, Kalpana Tiwari, has expressed her displeasure with the court's decision.
Calling it "shoddy," she said she would appeal it in a higher court. She said she had been watching the court's decision since this morning. She had hoped they would get justice, but the verdict is unjust.
Kalpana Tiwari said, "Prashant Choudhary was a trained police officer. How could he possibly have made a mistake in firing? My husband was shot dead. Both officers were present at the scene."
Kalpana also questioned the acquittal of the second accused, Sandeep Kumar.
She said, "Acquitting Sandeep is also a wrong decision. Both officers are equally at fault."
An emotional Kalpana asked, "What will I answer to my children now?"
The family has been waiting for justice in this case for a long time, but the court's decision has disappointed them.
It is noteworthy that Vivek Tiwari was shot dead in Lucknow's Gomti Nagar area on the night of September 28, 2018. He was driving his car when police officers attempted to stop him.
Following the incident, a case was filed against constables Prashant Choudhary and Sandeep Kumar. Both were later dismissed from police service.
Following the incident, a case was registered at Lucknow's Gomti Nagar police station based on a complaint by Vivek Tiwari's colleague, Sana Khan.
Both constables were subsequently arrested and suspended.
The Special Investigation Team (SIT) investigated the case, and a charge sheet was filed after the probe was completed.
The case subsequently went to trial in the Lucknow District Court.
The final arguments were completed on August 6 after the completion of the judicial process including witness statements and evidence in the case.
