Court issues notice to Riyas, Veena in false affidavit case over Rs 1.72 crore

Thiruvananthapuram, Oct 15 (UNI) A Thiruvananthapuram court has issued notice to former Public Works and Tourism Minister P.A. Mohammed Riyas and his wife Veena Vijayan in a petition alleging concealment of Rs 1.72 crore received by her from Cochin Minerals and Rutile Ltd (CMRL) in election affidavits.
The notice follows a revision petition filed by advocate Neyyattinkara P. Nagaraj challenging a magistrate court's decision to dismiss his complaint seeking criminal action against the couple for allegedly submitting false affidavits and concealing material information.
The petitioner has sought directions to register a case against Riyas and Veena or order a police investigation to collect further evidence.
The magistrate court had dismissed the complaint after accepting a Museum police report that the Election Commission was the competent authority to deal with the matter. The petitioner, however, argued that the allegations constituted criminal offences punishable with imprisonment of up to six months and a fine, bringing them within the jurisdiction of the criminal court.
The complaint alleges that Veena concealed her ownership of IT consultancy firm Exalogic Solutions in her election affidavit and failed to disclose a contract between her company and CMRL, headed by Sasidharan Kartha. It alleges that the relevant section seeking details of contracts entered into by the candidate's spouse was answered in the negative despite the alleged agreement.
The petitioner has also alleged that the Rs 1.72 crore identified by the Income Tax Department as payments from CMRL for services allegedly not rendered was concealed in the affidavits.
The complaint seeks action under Section 125A of the Representation of the People Act, which deals with false information or concealment in election affidavits, besides provisions relating to criminal conspiracy and common intention.
The petition relies on documents, including a 73-page order of the Income Tax Department's Interim Settlement Board and election affidavits filed by Riyas in 2021 and 2026.
The magistrate court had earlier directed the police to investigate the allegations and submit a report. The allegations against Riyas and Veena are yet to be established in court.
