Kerala HC rejects appeals by Pinarayi Vijayan, Veena and Riyas in CMRL case

Kochi, Oct 15 (UNI) The Kerala High Court on Thursday rejected the appeals filed by former Chief Minister Pinarayi Vijayan, his daughter Veena T. and son-in-law P.A. Mohammed Riyas challenging a Single Bench order directing the Vigilance and Anti-Corruption Bureau (VACB) to register an FIR in the CMRL-Exalogic case.
The Division Bench of Justices K. Natarajan and Johnson John declined to grant them leave to appeal against the October 9 judgment, which had directed the registration of a case based on material provided by the Enforcement Directorate (ED) concerning alleged financial transactions between Cochin Minerals and Rutile Ltd (CMRL) and Exalogic Solutions, a company associated with Veena.
The petitioners had argued that the Single Bench passed the order without hearing them, violating the principles of natural justice. They also challenged the decision to direct registration of an FIR without a preliminary inquiry.
The Bench observed that the petitioners remained free to seek relief through other legal channels, including approaching the High Court under Article 226 of the Constitution to quash the FIR before a court takes cognisance of the offence. It also noted that proceedings could be challenged under Section 528 of the Bharatiya Nagarik Suraksha Sanhita after cognisance.
The Division Bench also agreed with the Single Bench that the available material did not warrant a preliminary inquiry before registering the FIR and that the accused had no legal right to insist on being heard before such registration.
The latest order clears the way for the VACB to proceed in accordance with the earlier direction, while leaving the petitioners free to pursue the remedies recognised by the court.
