Madras HC dismisses as withdrawn, plea against TN Fin Minister Marie Wilson

Chennai, Oct 12 (UNI) The Madras High Court on Monday dismissed as withdrawn, a PIL seeking registration of a case against Tamil Nadu Finance Minister N. Marie Wilson over his remarks in the Assembly admitting that he was a victim of corruption in the School Education department having provided bribe during the previous DMK regime.
The public interest litigation was filed by advocate K. Sivasubramaniam seeking a direction to the Directorate of Vigilance and Anti-Corruption (DVAC) to register a case against the Minister under the Prevention of Corruption Act on the grounds that not only receiving money, but also giving it tantamounted to corruption and was a criminal offence.
In his petition, the advocate said Marie Wilson had openly admitted in the State Assembly about paying bribe during the previous DMK government to secure recognition and permission for an educational institution. Contending that giving a bribe was also an offence, he said on August 26, he had sent a formal written criminal complaint to the DVAC by Speed Post, seeking registration of an FIR against
the Minister under Sections 8 and 12 of the Prevention of Corruption Act, 1988, read with Section 173 of the BNSS, 2023.
However, the Anti-Corruption agency had neilther failed to act on the complaint, nor register an FIR. It had also not initiated any investigation against Marie Wilson, he alleged.
The admission of bribe-giving by a sitting Cabinet Minister had caused intense public outrage, affected the dignity of the Legislative Assembly, and compromised public trust in governance, he contended and sought a direction to the DVAC to register a case based on
the complaint and the Minister's remarks.
When the case came up for hearing, the First Bench comprising Chief Justice S.A.Dharmadhikari and Justice G.Arulmurgan the petitioner's counsel sought permission to withdraw the petition.
Accepting the request, the Bench dismissed the plea as withdrawn.
