Madras HC dismisses as withdrawn, poll plea against MDMK Sirkazhi MLA Senthilselvan

Chennai, Oct 12 (UNI) The Madras High Court on Monday dismissed as withdrawn, an election petition filed against the victory of MDMK MLA Senthilselvan from the Sirkazhi Assembly constituency.
Senthilselvan contested the April Assembly election from the Sirkazhi (Reserved) constituency as an MDMK candidate as part of the multi-party DMK-led Secular Progressive Alliance on DMK's Rising Sun symbol and got elected with a margin of 11,417 votes.
Challenging his victory, one of the voters, Vasu, moved the court and Senthilselvan, who had since distanced away from MDMK after
it broke ranks with the DMK front and allied with the ruling TVK headed by Vijay, also filed a petition seeking dismissal of the poll petition against him. Having got elected under the DMK symbol, he quit the party and joined the DMK and continued as a Legislator
of that party.
Vasu had earlier informed the court of his intention to withdraw the case.
When the matter came up for hearing before Ms.Justice D.Bharatha Chakravarthy today, the court allowed the petitioner's prayer and dismissed the case as withdrawn.
As per the usual procedure, when a petitioner seeks to withdraw an election petition, the High Court generally provides 15 days for objections to be raised or for any other person to proceed the case as a substitute, if necessary. As no one came forward to challenge Senthilselvan's victory or file another election petition within the stipulated period, the court dismissed the case following the withdrawal request.
