No relief beyond prescribed limit to complete MBA: HP High Court

Shimla, Jun 16 (UNI) In a significant judgment, the Himachal Pradesh High Court has dismissed a writ petition filed by an HAS officer, Mohit Shukla, who sought an exemption to complete his MBA course beyond the prescribed period of six years.
"The Court held that professional courses like MBA are bound by strict academic timelines, and personal choices, such as preparing for competitive examinations, cannot form the basis for relaxation in these limits."
Justice Ajay Mohan Goel, while pronouncing the verdict in CWP No. 4779 of 2025, observed that the petitioner was fully aware of the course structure and the six-year completion clause as per Ordinance 10.33 of Himachal Pradesh University’s First Ordinance.
Shukla, who enrolled in an MBA programme through ICDEOL in 2015-16 after his B.Tech and employment with SJVNL, had passed three semesters but did not appear for the fourth semester exam in 2017, citing preparations for the Himachal Pradesh Administrative Services (HAS) exam.
While Shukla eventually cleared the HAS exam in his third attempt and joined the service in January 2020, he approached the University in 2024 seeking a special chance to complete his pending semester. The University denied the request, stating that there was no provision to extend the course period beyond six years, and the Court upheld this decision.
“The MBA is a professional course, and six years is a sufficient time frame to complete a two-year programme,” Justice Goel remarked, adding, “Preparation for other examinations is a personal choice and cannot be a ground for exemption from prescribed academic timelines.”
The Court also rejected the petitioner’s argument that similar relaxation had been given to students of other post-graduate and undergraduate courses, stating that such concessions were not extended to professional courses like MBA.
The ruling sends a clear message to students pursuing professional degrees: academic obligations must be fulfilled within stipulated time limits, and personal career pursuits cannot justify deviation.
The judgment underscores that institutions must uphold their ordinances uniformly and refrain from granting ad hoc relaxations in academic regulations. UNI ML SSP
