Plea in SC challenges appointments of CEC Gyanesh Kumar, ECs Sandhu, Joshi

New Delhi, Oct 8 (UNI) A petition has been filed in the Supreme Court seeking writs of quo warranto against Chief Election Commissioner Gyanesh Kumar and Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi, alleging that their appointments violated the procedure laid down under the Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023.
Filed under Article 32 by Suri Payala, the plea challenges the March 14, 2024 notifications appointing Kumar and Sandhu as Election Commissioners, as well as the February 17, 2025 notification appointing Kumar as CEC and Joshi as Election Commissioner.
The petitioner has alleged that the appointments did not comply with Sections 5, 6 and 8(1) of the 2023 Act.
The petition challenges the Search Committee’s recommendation process, alleging that it recommended only six names for two Election Commissioner vacancies in March 2024, instead of the 10 names required under Section 6 of the 2023 Act. It also questions the selection process, noting that Gyanesh Kumar and Sukhbir Singh Sandhu were selected on the same day the six names were recommended.
The petitioner further alleges that the appointments did not meet the eligibility and transparency requirements under Sections 5 and 8(1) of the Act. It claims the publicly available service records of Kumar, Sandhu and Vivek Joshi do not specifically show prior experience in the management or conduct of elections, while acknowledging that any such assignments not reflected in the records may be with the government or the Election Commission.
