Shopian court orders reopening of Siraj-ul-Uloom seminary shut under UAPA

Srinagar, Sept 24 (UNI) In an interim relief, a court in Shopian has ordered the reopening of Darul Uloom Jamia Siraj-ul-Uloom at Hillow, Imam Sahib, allowing the institution to resume educational activities while proceedings concerning its status remain pending.
District Judge Shopian Mahmood Ahmad Chowdhury passed the order after hearing an application seeking interim relief against the continued closure of the institution, which was shut following proceedings under the Unlawful Activities (Prevention) Act (UAPA) in April this year.
Advocates S.M. Iqbal and Bashrat Abdullah represented the institution before the court.
Advocate Iqbal said the court had permitted the institute to reopen subject to certain conditions.
He said the court had directed the administration to constitute a three-member supervisory committee, including an officer from the Education Department and an officer from administration, and a respectable member from the Shopian to supervise the functioning of the institution.
The court has also directed that the reopening of the institution be publicised through newspapers and other media so that students who had left the institution could return, Iqbal said.
The lawyer said the court had also issued directions concerning the institution's assets, including its orchards.
The application followed objections filed in the proceedings, after which arguments were heard for seven days. The court subsequently passed interim directions permitting the institution to reopen, according to the counsel.
The reopening order comes nearly five months after the Jammu and Kashmir administration declared Jamia Siraj-ul-Uloom an “unlawful entity” under Section 8(1) of the UAPA. The administration's April order alleged that the institution had “sustained and covert linkages” with the banned Jamaat-e-Islami and cited alleged financial, administrative and legal irregularities. It also alleged that the institution had fostered an environment conducive to radicalisation.
The administration had subsequently sealed the premises and prohibited entry following the notification under the UAPA. The institution has in the past denied affiliation with Jamaat-e-Islami.
