HC raps Maha police for failing to shift Badlapur death case to SIT

Mumbai, Apr 25 (UNI) The Bombay Court on Friday rapped the Maharashtra Police for failing to transfer the probe into the custodial death of the Badlapur sexual assault accused to a Special Investigation Team (SIT) formed by the judiciary,

A division bench of Justices Revati Mohite-Dere and Dr Neela Gokhalem which was hearing the petition, said the act of not transferring the case despite clear orders amounts to criminal contempt of court.

Amicus Curiae and Sr Adv Manjula Rao informed the court that despite orders to transfer the papers, nothing has been done yet.

The court also expressed displeasure over no FIR registered against the policemen who are suspected to be involved in the death of the accused.

During the hearing, the court had summoned two officials, Jt CP Lakhmi Gautam and an officer of State CID to appear before the court in the afternoon during the day .

Jt commissioner Lakshmi Gautam appeared before the bench while state CID chief Parshant Burde appeared through video conference and assured the court that the relevant papers will be hand over to court formed SIT by the evening .

Earlier, the Bombay High Court ordered the formation of the SIT and the registration of an FIR within two days against five policemen implicated in the death of the accused Akshay Shinde.

Justices Revati Mohite-Dere and Neela Gokhale directed that the SIT be established under Joint Commissioner of Police (Crime) Lakhmi Gautam, who will enlist officers from various police stations.


The accused cops are Senior Police Inspector Sanjay Shinde, Assistant Police Inspector Nilesh More, Head Constables Abhijeet More and Harish Tawade, and Police Constable Satish Khatal, who were escorting Shinde from Taloja prison when he died from gunshot wounds. UNI AAA SSP
