Himachal: HC grants interim bail to ex-MLA Rajinder Rana's family in mining fraud case

Shimla, May 3 (UNI) The Himachal Pradesh High Court has granted interim bail to Anita Rana, wife of former BJP MLA Rajinder Rana, their son Abhishek Rana and another accused Kamlesh Kumar in a high-profile mining fraud case.
Justice Virender Singh passed the order while disposing of their petitions seeking interim relief from arrest.
The case stems from an FIR (first information report) filed by Anil Chauhan, owner of a crusher company based in Sirmaur district, under the jurisdiction of Pachhad Police Station.
Chauhan alleged criminal breach of trust and theft involving the accused, citing a fallout over business
agreements made in 2021.
As per the FIR, Chauhan had entered into a business agreement on August 12, 2021, with clear terms
regarding profit sharing and the handling of company assets. However, he claims that these terms were later violated. Specifically, he accused Abhishek Rana and Anita Rana of conspiring to unlawfully take possession of a JCB machine—an essential and costly piece of equipment—without consent. Chauhan asserted that he alone bore the cost of the machine and paid its EMI.
The FIR has been registered under Sections 316(2) and 3(5) of the Bharatiya Nyaya Sanhita (BNS) 2023, on March 13, 2015, which pertained to fraudulent acts and misappropriation.
Defending himself, Abhishek Rana alleged that the FIR was politically motivated and claimed that Ashish Chauhan himself is facing criminal charges in Punjab’s Mohali district. He maintained that the case was filed under the influence of the state government to target his family.
The crusher unit, located in the Pachhad region of Sirmaur, has now become a focal point of legal and political controversy in the state.
With interim bail granted, the accused will now await further hearings as investigations continue.
The case has stirred political and business circles in Himachal Pradesh, given the involvement of a prominent political family and the serious nature of the charges related to the state's mining sector.
