Himachal HC sets aside Sukhu govt decision to reemploy official

Shimla, Apr 1 (UNI) In a landmark decision, the Himachal Pradesh High Court on Tuesday struck down the SS Sukhu government's decision to provide re-employment to. Pradeep Sharma as Director of Animal Husbandry for flouting established rules.
The ruling, delivered by a division bench comprising Justices Tarlok Singh Chauhan and Sushil Kukreja, saidthe re-employment granted to Sharma on January 2 was illegal as it violated the mandatory provisions of Chapter 22 of the Handbook on Personnel Matters.
The bench emphasised that such decisions must be based on "exceptional circumstances" and "public interest," neither of which was satisfactorily demonstrated in this case. Instead, the re-employment appeared to stem from a ministerial recommendation rather than a rigorous assessment of necessity or merit.
The judgment highlighted glaring procedural lapses, including the absence of an integrity certificate and the failure to follow the prescribed proforma for re-employment. The court noted that such arbitrary actions not only undermine administrative efficiency but also deprive eligible officers of their rightful promotions, creating a domino effect that stalls career progression for many.
In a significant directive, the court ordered the immediate termination of Sharma’s re-employment and mandated the convening of a fresh Departmental Promotion Committee (DPC) to consider promotions for eligible candidates, including petitioner Vishal Sharma, who had been unjustly sidelined despite being in line for the post.
