Bihar: Patna HC quashes indefinite expulsion of MGCU student

Patna, Sep 24 (UNI) The Patna High Court has quashed an indefinite expulsion order issued by Mahatma Gandhi Central University (MGCU) against PG Media Studies student Akash Kumar and directed the university to immediately reinstate him and allow him to appear in examinations.
Kumar had been suspended and subsequently expelled after using social media to raise allegations of administrative irregularities concerning the promotion of a non-teaching staff member.
The university had barred him indefinitely from all its campuses. Kumar challenged the action before the High Court, contending that he had not been supplied a copy of the inquiry report or served with a specific show-cause notice before the extreme punishment of expulsion was imposed.
Justice Harish Kumar, while hearing the matter, came down heavily on the procedure followed by the university and observed that an unspecified ban could destroy a student''s academic future, describing it as “a civil death of the academic career of a student” and holding that such a punishment could not be sustained in law.
The court observed that even before imposing the extreme punishment of indefinite expulsion, which prima facie appeared not to be authorised under the relevant Act and Ordinance, the student had not been served with a specific show-cause notice along with the inquiry report.
The High Court held that the action of the university authorities did not meet the test of fairness and violated the principles of natural justice.
Setting aside the expulsion order issued by the university''s OSD (Administration) on August 14, 2024, the court directed MGCU to immediately induct Kumar back into his programme and permit him to appear in examinations.
The court, however, observed that the student would be expected to maintain discipline going forward.
