BJD Chief Whip welcomes Orissa High Court’s intervention in disqualification case against eight MLAs

Bhubaneswar, Oct 29 (UNI) Biju Janata Dal (BJD) Senior Vice-President and Chief Whip in the Odisha Legislative Assembly, Pramila Mallik, on Thursday welcomed the Orissa High Court’s intervention in the case seeking the disqualification of eight MLAs elected on BJD tickets over alleged cross-voting in the Rajya Sabha elections.
Addressing a press conference at the party headquarters in Bhubaneswar, Mallik said the BJD had earlier approached the Speaker of the Odisha Legislative Assembly, seeking the disqualification of the eight MLAs in accordance with the prescribed rules. The party had alleged that the legislators had engaged in cross-voting during the Rajya Sabha elections.
Mallik alleged that the Speaker declined to entertain the petition, citing procedural irregularities, and dismissed it without adequately considering the matter. She further alleged that the decision was politically motivated.
Following the Speaker’s decision, the BJD approached the Orissa High Court about a month ago, seeking judicial intervention in the matter. According to Mallik, the High Court admitted the case and issued a notice to the Speaker, who subsequently sought time to file a response.
She further stated that the High Court had issued notices to five MLAs, asking them to explain why their membership of the Odisha Legislative Assembly should not be disqualified and directing them to present their respective positions before the court.
Mallik also criticised the Advocate General’s reported remarks to the media, alleging that instead of expressing his views on the disqualification of the MLAs accused of cross-voting in the Rajya Sabha elections, he had commented on the BJD’s petition submitted to the Speaker seeking their disqualification.
Reaffirming the party’s faith in the judiciary, Mallik expressed hope that the matter would be resolved within a stipulated time frame. She said the BJD would present the relevant constitutional and legal issues with due respect for the judicial process and in accordance with established legal principles.
The BJD, she added, remains confident that the judicial proceedings will provide an appropriate forum for addressing the issues surrounding the alleged cross-voting and the disqualification petition.
