BMC Commissioner Ashwini Bhide Seeks Withdrawal of SRA’s Special Planning Authority Status

Mumbai, Nov 7 (UNI) Mumbai Municipal Commissioner Ashwini Bhide has written to Chief Minister Devendra Fadnavis, raising serious objections to the functioning of the Slum Rehabilitation Authority (SRA) and its alleged misuse of development concessions under Regulation 33(11) of the Development Control and Promotion Regulations (DCPR).
In her letter, Bhide has objected to the SRA granting concessions meant for slum rehabilitation projects to plots that do not have slums. She has urged the state government to withdraw the SRA's status as a Special Planning Authority and bring all development proposals under Regulation 33(11) within the jurisdiction of the Brihanmumbai Municipal Corporation (BMC).
The Commissioner has pointed out that although Regulation 33(11) does not provide for such concessions, the SRA is allegedly extending benefits available under Regulation 33(10), which governs slum rehabilitation schemes, to non-slum plots as well.
The letter also highlights instances where non-slum plots are being clubbed with slum-occupied land, allowing developers to avail themselves of similar concessions. According to the Commissioner, this practice results in construction permissions being granted on criteria less stringent than those applicable under the city's general development regulations.
Bhide has also raised concerns over proposals involving the transfer of Project-Affected Tenements (PTC) from one location to distant areas. In particular, she has questioned arrangements under which tenements linked to projects in one locality are being provided in areas far away, including cases involving the Bandra-Dahisar belt.
The Commissioner has further pointed out that development proposals involving non-slum plots in prominent localities such as Bandra, Juhu, Worli and Malabar Hill are being submitted to the SRA instead of the BMC. This, she has argued, could adversely affect the revenue of both the municipal corporation and the state government, as developers are approaching the SRA for approvals and concessions.
Among the key demands made by Bhide is strict implementation of the guidelines issued on October 15, 2024, under Section 154 of the Maharashtra Regional and Town Planning Act, 1966. She has sought clear directions to ensure that concessions available under Regulation 33(10) for slum rehabilitation are not extended to projects governed by Regulation 33(11).
She has also urged the Urban Development Department to withdraw the SRA's Special Planning Authority status and transfer all development proposals under Regulation 33(11) to the BMC. UNI SP CDS
