Ex-DMK Min Anbil's main plea to quash FIR in school fraud case, adjourned to Nov 10 by Madras HC

Chennai, Oct 29 (UNI) The Madras High Court on Thursday adjourned the November 10, the main plea filed by ex-DMK Minister Anbil Mahesh Poyyamozhi seeking to quash the FIR in the Rs 100 crore private school fraud case.
When the hearing resumed on plea before Justice V Lakshminarayanan, public prosecutor P.John Satyan, representing the Central Crime Branch (CCB) police probing the case, submitted that Anbil Mahesh had been arrested and that a petition was filed before the Special Court seeking permission for custodial interrogation to unravel the multi-crore money trail, running to over Rs 400 crores and to identify the beneficiaries.
He also informed the court that the key suspect and third accused in the case former MLA Muthukumar, who had been absconding, had surrendered before the special court on Thursday.
Senior counsel P Wilson, appearing for Mahesh, alleged that more than 40 police personnel had barged into his office and arrested the former minister while he was discussing the next course of action after the High Court dismissed his anticipatory bail petition. Questioning the police action, he asked whether a police state was prevailing in Tamil Nadu and alleged that the police had acted in violation of the Constitution.
The police, however, contended that they had waited outside the senior counsel's office for one-and-a-half hours before arresting Mahesh. They also said the special court had rejected the allegation that the arrest took place inside the advocate's office.
The Judge pointed out that the special court had rejected the allegation. Mahesh's counsel said they would challenge the order and were advised by the judge to file a petition along with video evidence.
The judge subsequently adjourned the hearing on the plea to quash the corruption case to November 10.
During the earlier hearing on October 12, the Judge, in a direct poser to the DMK, sought to know when did the DMK started talking of the Governor's powers after comparing the gubernatorial post to that of a "goat's beard" and that both were unnecessary. He questioned the DMK's stance on the Governor's powers, and asked "When did the DMK start talking about the Governor's powers?" and comparing the Governor's position to a "goat's beard" from the party's traditional viewpoint.
The Judge put the poser after the former School Education Minister's counsel argued that only the Governor can grant sanction to register a FIR and conduct a probe against him under Section 17A of the Prevention of Corruption Act rather than just the State government's Public Department Secretary.
The judge questioned the sudden reliance on the Governor's authority by the DMK, noting the party's historically critical stance regarding the office and powers of the Governor. As far as the DMK is concerned, it's stand was there was no need for a post of Governor.
After the police in its counter-affidavit justified registering the corruption case and contended that the Governor's sanction was not necessary, the Judge after hearing arguments from both the sides, adjourned the case to today and was now posted to November 10.
So far, the CCB police has arrested four people, including Anbil Mahesh Poyyamozhi, the prime accused BT.Arasakumar, claimed to be the President of the unrecognised Tamil Nadu Private Schools Association, and two others, Suresh and Raja.
In this backdrop, Muthukumar surrendered before Special Court Judge L.S. Sathyamurthy after the police widened the probe. In a related development, Anbil's bail plea, in which he also tagged the quashing his arrest as regular procedures were not followed, was posted to November two and it would be heard along with the police custody plea.
