Haryana circulates legal assistance rules for serving, retired All India Service officers

Panchkula, Oct 6 (UNI) The Haryana government has circulated to All India Service officers instructions governing legal and financial assistance in cases arising from official duties, including provisions applicable to retired members of the services.
The Personnel Department, Haryana Chief Secretary’s Office, in a communication dated September 30, 2026, forwarded the instructions received from the Government of India’s Department of Personnel and Training to all IAS officers in the state. The communication also directs that the instructions be circulated to IPS and Indian Forest Service officers in their respective departments. Legal-Assistance
The instructions are based on the existing framework under which the provisions relating to legal and financial assistance to government servants have been extended to retired members of the All India Services. The underlying government order dates back to 1977 and specifically extends the relevant provisions to retired All India Service officers. Under the provisions, legal and financial assistance may be considered for a retired government servant facing legal proceedings instituted by a private party in respect of matters connected with the officer’s official duties or position before retirement. The assistance is subject to the facts and circumstances of each case and the conditions prescribed under the rules.
The framework does not provide blanket legal protection. The government may consider undertaking the defence where it is satisfied that doing so is in the public interest. The prescribed procedure also requires the retired officer to furnish an undertaking in the specified form where the government undertakes the defence.
The rules also distinguish between proceedings connected with official duties and proceedings arising from matters unrelated to an officer’s official position. Legal expenses in purely private matters are not covered by the official-duty assistance provisions.
For retired government servants, the underlying provision provides for an interest-free advance towards legal expenses, subject to a maximum of Rs 500. Importantly, the extension of the assistance provisions to retired government servants specifically excludes the provision relating to an advance from the Provident Fund.
The instructions further provide for the prescribed declaration and bond, where the government undertakes the defence or an advance is granted for legal expenses. The competent administrative authority is to take the decision in individual cases, with consultation with the Finance and Law authorities wherever required.
The document also refers to proceedings initiated by a government servant to vindicate his or her official conduct. In such cases, the applicable conditions include obtaining the required government sanction and following the prescribed procedure. Another provision circulated by Haryana deals with the assistance that a serving All India Service officer may take from a retired government servant in disciplinary proceedings. It stipulates that no retired government servant can take up more than three cases at a time and requires the retired officer to certify that the prescribed limit is not exceeded.
The Haryana communication is therefore essentially a circulation of the applicable All India Services legal-assistance instructions, bringing the provisions to the notice of serving officers in the state and the concerned IPS and Indian Forest Service officers.
The official Haryana Chief Secretary Office has listed the communication under the title “Legal assistance instructions for AIS officers”, dated October 1, 2026.
