Haryana proposes major zoning overhaul, moves to ‘everything permitted unless prohibited’ regime

Panchkula, Oct 1 (UNI) Haryana has proposed a major change to its development rules, aiming to allow more types of land use by replacing the current system of allowed activities with lists of banned uses for each zone.
Under the proposed system, any activity not specifically banned in a land-use zone would be allowed, in line with current policy rules — a big change that could affect homeowners, landowners, developers, traders, and businesses across the state.
The Town and Country Planning Department suggested these changes as part of Phase-II of the Centre's effort to reduce rules and simplify processes, focusing on allowing uses based on demand with the idea that “Everything is permitted until prohibited.”
“Except the following prohibited uses, all other activities shall be permissible in the respective land use zones in accordance with the prevailing policy parameters,” the proposed regulations say.
Residential areas would still be protected from many industrial, logistics, and potentially dangerous activities. The banned list includes industrial units except local service industries, industrial colonies, waste-to-energy and recycling plants, ready-mix concrete and hot-mix plants, cyber parks, IT parks, IT units, and data centres. Large logistics parks, container depots, customs-bonded areas, warehouses, storage facilities, and gas storage would also be banned, along with wholesale businesses and transport hubs. Airports, air stations, sky sports, helipads, railway yards, stations, bus terminals, truck parking, goods terminals, and loading areas are also banned.
The proposal also bans sewage treatment and disposal sites, solid waste, construction and demolition waste, biomedical waste management sites, cremation and burial grounds, slaughterhouses, dairy farms, cattle ponds, tanneries, and fish markets. Dairy and poultry farming, mining, quarrying, stone crushing, and harmful or dangerous trades, including those with explosives, would also be banned in residential zones. Industrial units other than the local service industry and industrial colonies. Waste-to-energy and recycling plants, cyber parks, IT parks, IT units and data centres would also be barred.
Large logistics parks, container depots, customs-bonded areas, and logistics parks would be banned, along with sewage treatment and disposal sites and solid, construction, demolition, and biomedical waste management locations. Farming, mining, quarrying, stone crushing, and harmful or dangerous trades involving explosives are also banned.
The proposed prohibited list for industrial zones is much shorter.
Residential and commercial colonies, schools, and farming activities like agriculture, horticulture, dairy, and poultry would be banned. Other activities would follow the new general rules and current policies.
Residential and commercial colonies would be prohibited in transport and communication zones.
The banned list also includes high-pollution industrial units, waste-to-energy and recycling plants, cyber parks, IT parks and units, institutional uses, and farming activities like agriculture, horticulture, dairy, and poultry. Industrial units, industrial colonies, and residential and commercial colonies would be banned in public and semi-public zones.
Banned activities would also include waste-to-energy and recycling plants, cyber parks and IT facilities, large logistics parks, container depots, customs-bonded areas, logistics parks, warehouses, storage, and gas storage. Wholesale businesses, transport hubs and depots, goods loading and unloading areas, certain waste management sites, gas facilities, slaughterhouses, cattle ponds, tanneries, and fish markets would also be banned. Farming activities such as agriculture, horticulture, dairy, and poultry would also be prohibited. Utility zones would have a long list of banned activities.
Homes and residential colonies, commercial colonies and businesses, including hotels, would be banned. Schools and health centres would also be banned. Social, religious, and recreational activities, clubs, community centres, and banquet halls would be banned, along with industrial units and colonies, service garages, and display centres. Cyber parks, IT parks, IT units, and data centres would also be banned. The list also includes large logistics parks, container depots, customs-bonded areas, logistics parks, warehouses, storage, gas storage, transport hubs and depots, and dairy and poultry farming.
Open-space zones would still have much stricter rules. The proposal says all other activities would be banned except parks, green areas, water bodies, sports activities, public utility services, fuel stations, public transport infrastructure, recreational activities, and cremation or burial grounds. Agriculture zones would have one of the shortest banned lists. Residential and commercial colonies, as well as high-pollution industrial units, would be banned.
Information technology businesses would also be banned except for data centres, which are clearly allowed. Any use would still have to comply with the new overall rules and current policies. The proposed relaxed rules would not apply the same way in Natural Conservation Zones and Special Zones. The notice says all activities not allowed under the specific development plans would still be banned in these areas.
The proposed amendments would concern development plans prepared by the Town and Country Planning Department, the Urban Local Bodies Department, and metropolitan development authorities under various Haryana laws, including the metropolitan development authority Acts governing Gurugram, Faridabad, Panchkula, Sonipat, and Hisar. People can submit objections and suggestions in writing to the Director, Town and Country Planning Department, Haryana, addressed to the Chief Coordinator Planner (NCR), at Nagar Yojana Bhawan, Sector 18A, Chandigarh, or through the email address specified in the public notice, within the stipulated 30-day period.
The Director would also retain the power to prohibit any additional use in public interest. The state government, meanwhile, may relax restrictions on a use or activity in the public interest under Section 7A of the Haryana Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963.
