Hearing in defamation case filed against Congress leader Rahul Gandhi postponed

Sultanpur, Sep 16 (UNI) The hearing in the defamation case filed against Congress leader Rahul Gandhi for his offensive remarks about union Home Minister Amit Shah has been postponed on Wednesday.

Santosh Pandey, the lawyer representing complainant BJP leader Vijay Mishra, requested more time for arguments.
He stated that he was unable to prepare due to his busy schedule at a religious event.
Rahul Gandhi's lawyer, Kashi Shukla, said that Magistrate Shubham Verma of the Special MP-MLA Court has given Santosh Pandey a final chance with a warning. The next hearing in the case will be on September 21.

Previously, BJP leader Vijay Mishra had filed a petition to have Rahul Gandhi's voice sample matched by a forensic science laboratory.

But this petition was rejected by both the trial court and the sessions court. Vijay Mishra challenged this order in the High Court, but the High Court also dismissed his petition. The last hearing took place on September 3. At that time, the lawyer for the complainant BJP leader informed the court that a petition had been filed in the High Court on September 1 in this matter.
Rahul Gandhi is accused of making offensive remarks against the then BJP National President and current union Home Minister Amit Shah in Bengaluru in 2018. On August 4, 2018, Vijay Mishra, former chairman of the District Cooperative Bank and a BJP leader, filed a defamation case against him in this matter.
In this case, the court summoned Rahul Gandhi to appear on November 27, 2023. When he failed to appear, a warrant was issued against him. Subsequently, Rahul Gandhi appeared in court on February 20, 2024, and secured bail. He submitted two sureties of Rs 25,000 each.
Rahul Gandhi recorded his statement on July 26, 2024. Prior to this, he had also appeared in court on February 20, where his statement was recorded. Following this, complainant Vijay Mishra filed an application for a voice sample matching with Rahul Gandhi's. The trial court rejected this application on May 2. A counter application filed in the Sessions Court was also dismissed on July 15.
