Jharkhand High Court orders Rs 8 lakh compensation in train death case

Ranchi, Oct 29 (UNI) The Jharkhand High Court has ordered the Railways to pay Rs 8 lakh in compensation to the family of a man who died after falling from a train, ruling that the absence of a railway ticket on the deceased's body was not, by itself, sufficient ground to reject the claim.
The court also directed payment of six per cent annual interest on the compensation from the date of filing the claim application until payment.
Justice Sanjay Kumar Dwivedi passed the order while allowing an appeal filed by the family of Banmali Gop, setting aside the Railway Claims Tribunal, Ranchi's order dated September 12, 2023, which had rejected the compensation claim.
According to the family's submission, Gop, a resident of the Chaibasa area in West Singhbhum district, boarded the Tata-Barbil passenger train at Jhinkpani station for Kendposi on September 1, 2017. His brother, Harish Gop, had accompanied him to the station and purchased a ticket for the journey, the family told the court.
The family said Gop fell from the crowded train near Kendposi station and died from his injuries. The tribunal had rejected the claim after finding insufficient grounds to treat him as a bona fide passenger, as no ticket was recovered from the body.
The Railways also questioned the absence of a co-passenger's testimony and differences in the reported timings of the incident and recovery of the body.
The High Court held that the Railways had failed to establish that the death fell within circumstances exempting it from compensation liability. It also noted that the required Divisional Railway Manager's report under the relevant 2003 rules had not been produced.
The compensation will benefit Gop's wife, Baijanti Gop, his mother, Jema Godin, and their two minor children.
