Kerala HC suspends sentence of former DGP Tomin J Thachankary in graft case

Kochi, Oct 15 (UNI) The Kerala High Court on Thursday suspended the four-year prison sentence awarded to former Director General of Police Tomin J Thachankary in a disproportionate assets case, subject to the condition that he deposit 75 per cent of the fine imposed by the trial court.
Justice A. Badharudeen passed the order on Thachankary's plea seeking suspension of the sentence during the pendency of his appeal against the conviction.
The former police chief was convicted by the Vigilance Court in Kottayam under the Prevention of Corruption Act and sentenced to four years of imprisonment. The court had also imposed a fine of Rs 30.84 lakh.
While considering the plea, the High Court observed that the trial court's findings could not be faulted at the prima facie stage. However, taking into account the four-year term of imprisonment, it held that the sentence could be suspended by imposing appropriate conditions in the interests of justice, despite the State's opposition.
The Vigilance Court had found that assets disproportionate to 52.33 per cent of Thachankary's known income remained even after allowing for the discrepancies established through evidence during the trial.
Thachankary subsequently approached the High Court challenging the conviction and seeking suspension of the sentence. The court had heard arguments from his counsel and the prosecution last month before reserving its order.
The latest order concerns suspension of the sentence pending appeal and does not set aside the conviction.
