Kolhapur: Special court judge S V Sahare quashes ED case against state minister Hasan Mushrif and his sons

Kolhapur, Nov 5 (UNI) Special court Judge S V Sahare has quashed the Enforcement Case Information Report (ECIR) filed on April 4, 2022 against state minister Hasan Mushrif, his sons and the Sarsenapati Santaji Ghorpade Sugar Factory.
Judge S. V. Sahare, while giving his decision on the matter, clarified that, "The main condition for taking action under the Money Laundering Act is the existence of a predicate offence. When the predicate offence itself has been quashed by the High Court, action under the PMLA cannot exist."
The ED had initiated an investigation into the case involving Hasan Mushrif, his sons and Sarsenapati Santaji Ghorpade Sugar Factory based on the original charges of a complaint filed by the Registrar of Companies (RoC) in March 2022 and an FIR lodged at Murgud Police Station in Kolhapur in February 2023.
The ED had alleged that the sugar factory had embezzled funds worth over Rs 11.35 crore through shell companies in Kolkata during 2013-2014.
During this investigation, the ED had seized fixed deposits worth Rs 2.07 crore and cash worth Rs 7.70 lakh in July 2024.
Mushrif had approached the Mumbai High Court against this action.
The local police investigating officer had submitted a C-Summary Report to the court, which was accepted by the court and the High Court quashed the FIR in June 2025.
The High Court had quashed the complaint proceedings of the Pune Court on November 6, 2025, clarifying that the 2021 amendments to the Companies Act were not applicable retrospectively.
"The Enforcement Directorate itself had submitted a closure report to the special court as both the original cases were quashed by the court. Now the court has given its final approval."
