Maha: Actor Imran Khan moves Bombay HC against Mumbai Police's ‘Quit India’ notice

Mumbai, Oct 17 (UNI) Actor Imran Khan, the nephew of actor Aamir Khan, has approached the Bombay High Court challenging a Mumbai police notice asking him to leave India by October 28 for his alleged participation in protest against Chief Election Commissioner (CEC) Gyanesh Kumar at the August Kranti Maidan, calling the order “arbitrary, unlawful and disproportionate”.
Actor Imran Khan who is a US citizen and Overseas Citizen of India (OCI) cardholder, has sought the quashing of the Leave India Notice issued by the Foreigners Regional Registration Office (FRRO) of the Mumbai police, along with an interim stay on its implementation.
In his petition to the High Court, Imran Khan contended that the Mumbai police's notice has violated his fundamental rights under Articles 14 and 21 of the Constitution of India.
He argued that there was no provision under the existing law which prohibited OCI cardholders from participating in peaceful protests in India.
“The notice has been issued without disclosing any reasons, supporting material, or specific statutory contravention,” actor’s plea stated, saying that it was issued without an inquiry, show-cause notice or an opportunity for him to explain his position.
Earlier, lawyers of actor Imran Khan, stated on Friday that he never participated in any protest held at the August Kranti Maidan at Nana Chowk against CEC Gyanesh Kumar, but was merely passing through the area.
The actor’s plea is expected to be mentioned before a division bench of Bombay High Court, comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna, for an urgent hearing.
Denying all police allegations, Imran Khan's lawyers Zulfikar Memon, Parvez Memon and Chirag Naik had submitted that their client, actor Imran Khan, was never part of the protest.
The lawyers had said that actor Imran Khan was merely passing through the Nana Chowk area on October 10, when the protest against CEC Gyanesh Kuman took place.
At that time, barricades were put up there and he was merely standing there and talking to the media, when the police picked him up, his lawyers had argued.
His lawyers had further argued that the actor was being implicated in this case and Imran Khan had no connection whatsoever with the protest or the anti-Gyanesh Kumar demonstration which took place at the venue, when he was passing through the venue.
“He was just passing through. He was seen in the crowd after the barricades were put up. The media immediately started scolding him. He had no intention of participating in any protest or demonstration. He is being unjustly implicated in the matter,” Imran Khan’s lawyers had stated.
The Mumbai police sent notice after actor Imran Khan was detained on October 10 for participating in a street protest at Mumbai’s August Kranti Maidan, against CEC Gyanesh Kumar.
After the October 10 protest demonstration, BJP leader Kirit Somaiya lodged a police complaint, in which he alleged that actor Imran Khan, who is a US citizen, breached provisions of the Foreigners Act by participating in a political protest.
