Multi-crore School graft case : Ex-DMK Minister Anbil Mahesh’s bail plea adjourned to Nov 2

Chennai, Oct 29 (UNI) A Special Court for cases under the Prevention of Corruption Act in Chennai on Thursday adjourned to November 2, hearing on a bail petition filed by senior DMK leader and former Tamil Nadu School Education Minister Anbil Mahesh Poyyamozhi in the multi-crore private school fraud case, to be heard along with the police plea seeking his custody for interrogation.
When his bail petition, in which he has also challenged his arrest alleging non-compliance of mandatory arrest procedures under Sec 36 of BNS as the FIR itself was registerd without the approval required under Sec 17A of the Prevention of Corruption Act, 1988, came up for hearing before Special Court Judge L.S.Sathyamoorthy, the prosecution informed that a plea was filed seeking permission to take Anbil Mahesh into police custody for interrogation.
Counsel for the ex-Minister said a separate petition had been filed seeking the return of electronic devices seized during the searches at his residence and requested it should also be taken up for hearing.
The Judge after directing the police to file their response to the bail plea, adjourned the hearing on all three petitions to November 2.
Two days after his arrest in the Rs 100 crore private school recognition graft case, which according to the investigators could cross Rs.400 crores, Anbil Mahesh filed the bail petition yesterday.
In his plea, bail Anbil contended that all the rules were followed while granting recognition and that he had not indulged in any wrongdoings. He also said he would not be held liable if his name was wrongly misused by some people.
Mahesh has stated that he had duly followed the prescribed rules and procedures while granting approval and did not indulge in any wrongdoing in the matter. Arguing that there was no specific material warranting his detention and that the probe could proceed without custody, he said he expressed his willingness to cooperate with the investigating agency and comply with any conditions imposed by the Court.
While denying the allegations levelled against him, Anbil sought bail citing his lack of criminal antecedents and his health condtion as
he was suffering from pacreatitis
Coininciding with this, the CCB police also conducted raids at the residences of prominent woman entrepreneur Shanmuga Priya in connection with the multi-crore scam. With reports indicating that the ex-Minister was linked to corruption to the tune of Rs 400 crores,
a 10-member team of CCB police descended on her Rams Ragasree Villa at Peungudi and conducted searches as part of the money trail probe, and seized certain incriminating documents.
Anbil Mahesh was arrested by the CCB police on October 26 hours after the Madras High Court dismissed his anticipatory bail petition. He was subsequently produced before the special court, which remanded him to judicial custody until November 6. He is currently lodged in Puzhal Central Prison.
He was the first ex-DMK Minister to be arrested in a corruption case after the TVK government headed by Chief Minister Vijay assumed office in May and started digging into various corrupt activities involving former Ministers during the previous DMK regime.
Police said the arrest was based on the material evidences collected during the raids conducted at Anbil's locations and those connected with him. One of the key aspect was that one Muthukumar, who was cited as the second accused in the case, was still absconding, though unconfirmed reports said his whereabouts were known to the ex-Minister.
While dismissing his advance bail plea, Mr Justice V.Lakshminaryanan observed that the ex-Minister was not an ordinary person and was politically influential who could tamper with the evidences. The Judge also said considering the huge involvement of money trail in the name of party funds (an euphemism for corruption coined by the present regime), which the police claimed as "financial terrorism", the beneficiaries could be identified only by interrogating the ex-Minister.
Accepting the police submissions, the Judge dismissed his advance bail plea as the investigations are at a preliminary stage following which, the CCB police arrested him leading to filing of a regular bail petition which was adjourned to November two.
