HC quashes recruitment notice for 100 Mizoram health worker posts

Aizawl, Oct 5 (UNI) The Gauhati High Court has cancelled Mizoram’s recruitment process for 100 health worker posts, directing the state government to first determine how many contractual National Health Mission (NHM) employees could be considered for regularisation before proceeding with fresh direct recruitment.


Justice Mridul Kumar Kalita, in an order issued on Thursday, set aside and quashed the advertisement issued by the Director of Health Services on July 22, 2025, inviting applications for the 100 health worker posts exclusively through direct recruitment.


The court directed the state government to undertake an exercise to identify the number of health workers currently engaged on a contractual basis under the NHM who could be considered for regular appointment against corresponding posts under the direct quota.


The exercise is to be carried out against the 100 posts and in accordance with the criteria prescribed under Clauses 3 and 4 of the Government of Mizoram Regularisation of Centrally Sponsored Scheme (CSS) Employees Scheme, 2024.


The court made it clear that the government must first determine the number of posts that can be set aside for regularisation of eligible contractual employees and the number that would remain available for direct recruitment.


Only after completing this exercise, the government can proceed with a fresh recruitment notification, the court said.


The fresh advertisement, if issued, must clearly specify the number of posts identified for regularisation and the number available for appointment through direct recruitment, according to the order.


The case arose from a writ petition filed in 2025 by 72 contractual employees working under the state’s NHM. They had challenged the July 22, 2025 advertisement on the ground that it sought to fill all 100 health worker posts through direct recruitment without taking into account the state government’s 2024 regularisation scheme.


The petitioners contended that the advertisement failed to provide for steps to implement the policy for regularising employees engaged under centrally sponsored schemes.


The Government of Mizoram Regularisation of Centrally Sponsored Scheme (CSS) Employees Scheme, 2024 provides for regularisation of eligible employees engaged under such schemes in phases.


The petitioners argued that the recruitment notification, by earmarking all the 100 posts for direct recruitment, effectively bypassed the provisions of the regularisation scheme and affected the contractual employees who could otherwise be considered for appointment against regular posts.


After examining the issue, the High Court held that the state government should first ascertain the number of contractual employees eligible for consideration under the 2024 scheme and the number of posts that would consequently remain for direct recruitment.


The ruling does not, therefore, direct automatic regularisation of all the petitioners. Instead, it requires the government to conduct the prescribed exercise and determine eligibility and the number of posts available for regularisation in accordance with the 2024 scheme.


The July 2025 advertisement has accordingly been quashed, requiring the recruitment process to be reconsidered in light of the regularisation policy.


Senior advocate C. Lalramzauva and advocate Stephen Lalbuatsaiha appeared for the petitioners, while government advocate Lalnunhlui represented the Mizoram government.
