PIL in SC seeks action against CEC Gyanesh Kumar, judicial probe into SIR voter deletions

New Delhi, Sep 25 (UNI) A PIL has been filed in the Supreme Court seeking action against Chief Election Commissioner Gyanesh Kumar and other senior Election Commission officials over allegations that decisions relating to the Special Intensive Revision (SIR) of electoral rolls were taken despite objections from two Election Commissioners. The petition has also sought a judicial inquiry commission or a Special Investigation Team probe into the alleged deletion of 13 crore voters during the SIR.

The plea, filed by advocate Shailendra Mani Tripathi, has sought a declaration that decisions taken by the Election Commission without concurrence of a majority of Election Commissioners be treated as illegal and void. It also seeks action against Senior Deputy Election Commissioner Maneesh Garg and ECI Director General (Information Technology) Seema Khanna.

According to the petition, official records show that between November 2025 and August 2026, Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi recorded written dissents or objections on at least 14 occasions to decisions allegedly taken unilaterally in the name of the Commission.

The PIL has also sought restoration of statutory Form 6 under the Registration of Electors Rules, 1960, contending that an ancestral linkage requirement (2003 SIR linkage) was introduced for first-time voters without legislative authority or amendment of the rules.

It further alleges that Electoral Registration Officers were deprived of their statutory powers and electoral-roll management was centralised under the ECI’s IT wing.

The petition also refers to the alleged absence of a software “rollback” facility, which, it claims, prevented restoration of 97 eligible voters in Goa despite repeated communications from the State election authorities seeking activation of the feature.

On the West Bengal SIR, the plea questions more than 16.10 lakh appeals allegedly filed by the ECI against restoration of voters earlier excluded from the rolls. It claims these appeals were filed without the knowledge or approval of the other two Election Commissioners or the State Chief Electoral Officer.

The petition further alleges that Senior Deputy Election Commissioner Maneesh Garg altered the IT oversight structure and removed DEC Sanjay Kumar from IT-related matters, prompting Election Commissioners Sandhu and Joshi to approach the Cabinet Secretary.
