Tarun Tejpal moves SC against 10-yr sentence; notice issued to Goa

New Delhi, Sep 25 (UNI) The Supreme Court on Friday issued notice to the Goa government on a petition filed by former Tehelka editor-in-chief Tarun Tejpal challenging the Bombay High Court judgment sentencing him to 10 years’ imprisonment in a 2013 rape case involving a colleague.
A bench comprising Justices MM Sundresh and Prasanna B Varale heard the matter.
Senior Advocate Kapil Sibal, appearing for Tejpal, submitted that the High Court had reversed his acquittal. “This is a case of reversal; there is a right of appeal; I have surrendered,” Sibal said.
Sibal sought a specific date for hearing Tejpal’s plea for suspension of sentence, after the Supreme Court agreed to issue notice to Goa. The bench said it would consider the request.
The Goa government has also approached the Supreme Court seeking enhancement of Tejpal’s sentence to life imprisonment.
The Bombay High Court on August 6 overturned Tejpal’s 2021 acquittal by the trial court, convicted him in the 2013 rape case and sentenced him to 10 years’ rigorous imprisonment.
The High Court rejected the trial court’s reasoning based on the victim’s post-incident conduct and held that there is no concept of a “perfect rape victim.” UNI XC RSA SAS
