Allahabad HC pulls up Noida Police over illegal detention

Prayagraj, Oct8 (UINI) The Allahabad High Court has come down heavily on the Uttar Pradesh Police over the alleged illegal detention of a youth in Gautam Buddha Nagar, terming the "detention unlawful and directing his immediate release."
During the hearing, the court expressed strong displeasure with the conduct of the Noida Police and observed, “You should be ashamed.”
The court further ruled that the condition of policing in the state was “very poor” and that some officers appeared to believe they could act with impunity.
"The state of the police in this state is very poor. Officers seem to think they can do anything. They can do it and get away with it," the court said.
A division bench comprising Justice Atul Shridhar and Justice Achal Sachdev made the observations while hearing a habeas corpus petition concerning Deepak, a resident of Gautam Buddha Nagar.
The court held Deepak’s detention illegal and allowed the habeas corpus petition, ordering his immediate release.
According to court records, police detained five people, including Deepak, at around 7:34 pm on August 23, 2026. However, the FIR was registered nearly two hours later, at 9:39 pm.
The bench noted discrepancies in the police action and documentation. It also expressed displeasure over the alleged failure to inform the accused of their right to consult a lawyer of their choice at the time of arrest.
The court further raised questions over the procedures followed in relation to the bail bond and arrest memo.
The observations came amid the court’s scrutiny of the circumstances surrounding the detention and the subsequent registration of the FIR.
