Odisha Revenue Board orders restoration of 1.5 acres of Amrut Manohi land to Lord Jagannath

Bhubaneswar, Oct 1 (UNI) The Odisha Revenue Board has ordered restoration of around 1.5 acres of valuable Amrut Manohi land near Gundicha Temple in Puri in the name of Lord Jagannath, after finding that subsequent private records and sale deeds could not override the original temple land records.
The Revenue Board passed the order in two cases involving the land in Talabania mouza of Puri, which was originally recorded in the name of Lord Jagannath as Amrut Manohi land in the 1889 Sabik record.
The land, located near the Gundicha Temple and considered valuable, was subsequently recorded in a private individual's name in 2002 and later transferred to another person through registered sale deeds.
The matter relating to change of kisam and the claim of private ownership subsequently reached the Odisha Revenue Board, which took up the cases suo motu under Section 32 of the Odisha Survey and Settlement Act, 1958.
The Board examined the Sabik and current records, sale deeds, origin of the land and the statutory provisions governing properties of the Sri Jagannath Temple.
A key legal issue before the Board was the requirement of prior approval of the State Government under Section 16(2) of the Sri Jagannath Temple Act, 1955, before any immovable property in the possession of the Temple Committee could be sold or otherwise transferred.
No evidence of the required prior approval of the State Government was produced in the cases.
The Board held that if the legality of the original transfer was not established, a subsequent sale deed could not cure the defect or validate the transfer.
It also considered the legal position that even any consent or no-objection claimed to have been given by the Temple Management Committee could not substitute the mandatory prior approval of the State Government.
After examining the discrepancy between the original land records and subsequent private records and transfers, the Revenue Board directed the concerned settlement authorities to reconcile the current and not-final records with the Sabik records and record the land in the name of "Sri Jagannath Mahaprabhu Bije, Puri, Marfat Temple Management Committee, Amrut Manohi status."
Revenue Board member Satyabrata Sahu directed the Sri Jagannath Temple Administration to take steps to bring around 1.5 acres of such land back into the account of Lord Jagannath.
The order effectively restores the original status of the land, which had subsequently entered private records and was transferred through sale deeds.
Government counsel Ambika Prasad Mishra strongly represented the legal interests of Lord Jagannath in the cases, arguing for protection of the deity's property.
The two cases are being viewed as significant in the context of protection of the records and legal status of Amrut Manohi properties belonging to Lord Jagannath.
The proceedings have also reaffirmed the legal position that the original rights over temple property cannot be altered merely on the basis of subsequent records, mutation or sale deeds when the statutory requirements for a valid transfer have not been fulfilled.
