RJD demands POCSO action against Bihar CM over Jamui victim photo

Patna, Sep 28 (UNI) The RJD on Monday demanded that the Bihar State Commission for Protection of Child Rights and the Bihar State Women's Commission initiate action under the POCSO Act against Chief Minister Samrat Choudhary over the publication of a photograph of a minor victim of the Jamui sexual assault case on social media.
Separate memoranda were submitted to Child Rights Commission chairman Amardeep and Women's Commission chairperson Apsara by RJD delegations, alleging that the photograph of the minor victim was shared on the Chief Minister's Facebook, Threads and X accounts.
Party spokesperson Chitrankan Gagan said here that the controversy had earlier led to an FIR against an employee of the Chief Minister's Office in connection with the posting of a photograph showing the Chief Minister with the minor and her family. The photograph was subsequently removed.
In its memorandum, the RJD alleged that despite the photograph being published on the Chief Minister's social media handles, no action had been taken against him under the relevant child-protection laws. The party sought proceedings under Sections 23(2) and 23(4) of the Protection of Children from Sexual Offences (POCSO) Act, Sections 74(1) and 74(3) of the Juvenile Justice Act and Section 72(1) of the Bharatiya Nyaya Sanhita (BNS).
The party also questioned why the Chief Minister had not publicly expressed regret over the episode and alleged that the incident raised wider questions about the protection of the identity and privacy of child victims of sexual offences.
The RJD cited the Supreme Court''s judgment in Nipun Saxena v. union of India, in which the court laid down safeguards against disclosure of the identity of victims of sexual offences. The Supreme Court has held that the identity of such victims should not be disclosed and that reporting must protect the dignity and privacy of the victim.
The RJD delegation told both the commissions that protection of a minor victim's identity was a statutory obligation and urged the authorities to examine the matter and initiate proceedings in accordance with law.
The party said that if the identity of a child victim can be disclosed from the social media account of a person holding a constitutional office without consequences, it would undermine the purpose of statutory safeguards meant to protect child victims.
