SC adjourns pleas challenging ECI functioning to Nov 17, grants 10 days for rejoinder

New Delhi, Oct 27 (UNI) The Supreme Court on Tuesday adjourned the hearing on a batch of petitions challenging the functioning of Chief Election Commissioner (CEC) Gyanesh Kumar and alleging unilateral decision-making by the Election Commission of India (ECI), including in matters relating to the Special Intensive Revision (SIR) of electoral rolls, to November 17.
A bench comprising CJI Surya Kant and Justices Joymalya Bagchi and V Mohana granted the petitioners 10 days to file rejoinders to the ECI's counter-affidavit.
Senior Advocate Abhishek Manu Singhvi, appearing for Leader of Opposition Rahul Gandhi and other INDIA bloc leaders, urged the court to direct the preservation of file-notings and internal communications to establish whether the Commission's decisions were unanimous or unilateral. The CJI assured the petitioners that the court would examine the issue.
Senior Advocate Menaka Guruswamy, representing TMC MP Dola Sen, alleged that the ECI had tampered with Form 6 and issued a press release claiming that the Supreme Court had approved it. However, Senior Advocate Maninder Singh, appearing for the ECI, dismissed the submissions as rhetoric.
In its counter-affidavit, the ECI denied the allegations of unilateral decision-making, maintaining that all decisions concerning the SIR exercise were taken unanimously and that Form 6, used for the inclusion of names in electoral rolls, had not been amended.
The petitions also question whether the Commission's functioning complies with Article 324 of the Constitution and Section 18 of the Chief Election Commissioner and Other Election Commissioners Act, 2023.
