Students protesting against MPSC malpractices are not anti-socials, says Bombay High Court

Mumbai, Oct 7 (UNI) The Bombay High Court stated here on Wednesday that students protesting against alleged malpractices in the Maharashtra Public Service Commission (MPSC) recruitment exams are not anti-social elements and the Maharashtra state government is duty-bound to ensure that MPSC exams are conducted impartially, without any malpractices.
The court heard a petition here on Wednesday which challenged the student protest in Pune which, according to the petitioners residing in Pune, namely Amit Supekar and Saurabh Virkar, has disrupted the daily life of Pune residents, due to traffic congestion affecting emergency services like ambulances and fire brigade movement.
The petition also demanded that there must be an exclusive area dedicated to protests in Pune, like there is Azad Maidan in Mumbai.
Presently, students agitating against the MPSC exam irregularities are protesting at SM Joshi Bridge, Alka Talkies and Lal Bahadur Shastri Road in Pune.
The hearing took place here on Wednesday before a Bombay High Court bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna.
The next hearing will be held on November 25.
According to political observers, the possibility of the Pune residents who filed the petition before the Bombay High Court working on behalf of those close to the Maharashtra state government cannot be entirely ruled out, since any strictures by the Bombay High Court against the students’ agitation, would directly help the Fadnavis government, which is struggling to defuse the agitation.
Hearing the petition, the Bombay High Court bench said, “The students are sincerely interested in pursuing their education. They are not interested in things like this agitation. However, the entire atmosphere is now vitiated. Therefore, honest and sincere efforts must be made to regain their trust.
"These innocent students have taken to the streets today. Their grievances should be resolved. The examination should be conducted in a free, fair and transparent manner”.
The Bombay High Court bench stated that it would review how the Maharashtra state government proceeds in the matter.
“We will review how the state government proceeds in this matter. The students must trust the court. If they suspect that there has been malpractice in the examination process, then they have the right to protest because they worked hard for many hours for this examination,” the Bombay High Court bench stated.
The Bombay High Court directed the Maharashtra state government to elaborately disclose within three weeks, about how exactly it proposed to hold MPSC exams, without any malpractices.
Advocate General Milind Sathe, who appeared before the Bombay High Court on behalf of the Maharashtra state government, said that the police has shown reasonable restraint and not lodged FIRs against any student protesters, adding that most of the demands raised by the protesters have been met.
“One of their demands was the resignation of the MPSC Chairman. A recommendation has been sent to the Governor as per the procedure and further action is awaited,” Advocate General Milind Sathe told the Bombay High Court.
“We appreciate the restraint shown by the police. An FIR can ruin the careers of students. They are students, and not anti-social elements. Their main complaint is that the examination should be conducted in a fair manner. All the issues should be brought to the notice of the court after a detailed inquiry,” the Bombay High Court said.
