Voters missing from SIR draft rolls can apply through Form 6 without fear of prosecution: Haryana CEO

Chandigarh, Nov 4 (UNI) Voters whose names are missing from draft electoral rolls during the Special Intensive Revision (SIR) can apply for inclusion through Form 6 even if they were registered earlier, and will not face legal action merely for submitting the form, Haryana Chief Electoral Officer A. Sreenivas said on Wednesday.
Sreenivas said the Election Commission of India, in a clarification issued on November 3, had stated that all eligible voters whose names did not appear in the draft electoral rolls could seek inclusion through Form 6 during or after the revision exercise, irrespective of their previous enrolment status.
The clarification addresses concerns among previously registered voters that submitting Form 6, which requires a declaration regarding first-time enrolment, could be treated as a false declaration and result in prosecution under Section 31 of the Representation of the People Act, 1950.
The Chief Electoral Officer said the Commission had made it clear that previous enrolment alone would not make the submission of Form 6 a false declaration.
An Electoral Registration Officer (ERO) cannot initiate proceedings under Section 31 solely because an applicant was registered in an earlier electoral roll and subsequently submitted Form 6 during or after the SIR exercise.
However, the applicant must not already be enrolled in the electoral roll of another parliamentary or Assembly constituency, and the declaration submitted must comply with the law.
Sreenivas said the Commission's clarification was also consistent with the Delhi High Court's October 14, 2026, order in the case of Nilotpal Datta and Another versus Election Commission of India and Others.
The court had addressed concerns that previously enrolled voters might expose themselves to legal action by submitting Form 6 to restore their names to the electoral rolls.
The Chief Electoral Officer said instructions had been issued to all district election officers in Haryana to publicise the clarification widely so that eligible citizens were not discouraged from applying for voter registration because of confusion over the procedure.
He said the clarification was particularly relevant to previously registered voters whose names were omitted from the draft rolls or remained excluded after final publication.
Such voters could submit Form 6 during the prescribed revision process, subsequent special enrolment drives or continuous updating of electoral rolls, subject to the Commission's guidelines.
Sreenivas said election officials had been directed to ensure that eligible citizens were made aware of the procedure and that no voter was prevented from seeking enrolment because of an incorrect understanding of the declaration required under Form 6.
