Minor girl returns home after 3 months following Tripura HC’s direction

Agartala, Oct 01 (UNI) Tripura High Court has ordered the State government to return a minor girl to her parents without delay.
She had been kept at a home in Agartala for three months. Accordingly, today Social Welfare officials handed her over to her parents in Gandacherra, in Tripura’s Dhalai district.
A division bench led by Chief Justice M S Ramachandra Rao issued the order while hearing a habeas corpus petition filed by the girl’s father, Gopal Das, and found that officials had sent the girl to a child care facility without following the Juvenile Justice (Care and Protection of Children) Act, 2000.
The case began in the last week of June, when a group of women entered Das’s home and assaulted his minor daughter. They accused her of causing social disorder. Das filed a police complaint naming those he said were responsible for the attack. Police took no action on his complaint and instead brought the girl to the police station.
The Sub-Divisional Magistrate later began proceedings and sent her to a juvenile home in Agartala.
The High Court found that the magistrate and the Dhalai district Child Welfare Committee (CWC) had not acted properly. Police, the magistrate, and Social Welfare officials were also named in the case.
The bench asked the State’s Advocate General what steps officials had taken while the girl was in custody. It pointed to the rules in Chapter III of the Juvenile Justice Act and asked whether the CWC had held an inquiry under Section 33(1) and made an appropriate order.
The State could not produce such an order, the court said in its ruling. The bench said the girl appeared to have been removed from her parents’ home based on allegations in a complaint, without the required legal steps. It called the action arbitrary and unlawful.
The court also found that the officials’ actions breached Articles 14 and 21 of the Constitution and the Juvenile Justice Act. It ordered the respondents to return the girl to her parents at once. State authorities must file a counter affidavit by the next hearing.
Senior advocate Purushottam Roy Barman, who represented the petitioner, said the accusations against the girl were anonymous and had no basis. He argued that she had been taken into custody without legal grounds. Das has also sought compensation and action against the officials responsible for the decision.
The next hearing is set for November 11.
