NHRC seeks probe into alleged use of minors at Mumbai CJP protest

Mumbai, Oct 3 (UNI) India’s National Human Rights Commission (NHRC) has sought an investigation into allegations that minors are being deliberately placed at the centre of a protest organised by the Cockroach Janta Party (CJP) in Mumbai, directing authorities to examine whether the children were used to deter police action.
The Commission has issued notices to the Mumbai Police Commissioner, the Ministry of Electronics and Information Technology (MeitY), the grievance officer of social media platform X and the principal secretary of Maharashtra’s Women and Child Development Department, seeking action taken reports within a week.
The action followed a complaint concerning the CJP's Oct. 2 protest at Mumbai's Shivaji Park, where demonstrators demanded the resignation of Chief Election Commissioner Gyanesh Kumar over alleged irregularities in the Special Intensive Revision (SIR) of electoral rolls.
The probe follows a formal complaint filed by Satish Vaidya, Head of Intervention at the Seva Nyay Utthan Foundation, regarding the Cockroach Janta Party’s (CJP) public agitation at Shivaji Park on October 2, 2026.
The protest drew intense scrutiny after digital footage surfaced showing minors hoisted over crowds amid inflammatory sloganeering.
Mumbai Police have been directed to inspect digital evidence, videos, and texts, and register an FIR if a cognizable offense is made out. Authorities must examine whether children's minority status was weaponized as a "shield" to deliberately bypass legal enforcement.
The NHRC said authorities should examine video footage, photographs, messages and other digital material to determine the circumstances in which minors participated in the protest and whether their presence was planned to prevent police intervention.
Mumbai Police have been asked to examine the available evidence and register a case if the investigation establishes that a cognisable offence was committed. The Commission has also called for preservation and forensic examination of relevant social media communications and group chats.
The probe will examine possible violations of Sections 75 and 83(2) of the Juvenile Justice (Care and Protection of Children) Act, 2015, according to the complaint and NHRC proceedings.
MeitY and X have been asked to preserve relevant digital material and examine the circulation of photographs and videos involving the children, including the accounts responsible for disseminating the material.
The Maharashtra Women and Child Development Department has been directed to ensure that the children receive appropriate protection and support through the Child Welfare Committee (CWC), while safeguarding their identities and dignity.
The NHRC has also expressed concern over the circulation of material identifying the minors and has sought examination of the role of adults, organisers and coordinators involved in the protest.
