Maha: HC quashes criminal case against builder Akhtar Hasan Rizvi in property dispute

Mumbai , Oct 11 (UNI) The Bombay High Court has quashed criminal proceedings against city-based builder and former MP, Dr Akhtar Hasan Rizvi, in a property dispute after the parties reached a settlement, while directing him to pay Rs 25,000 to a charitable trust working for children with special needs.
Justice Milind N Jadhav allowed the criminal writ petition filed by Rizvi, subject to compliance with the conditions imposed by the court.
The dispute arose from a mutation entry dating back to 1979 concerning a 300-square-metre plot. The parties subsequently resolved their differences through consent terms, under which the complainant, Abdul Shaikh, secured rights over the disputed plot without Rizvi deriving any benefit, according to reports on the court proceedings.
The court observed that criminal proceedings should not be used as a means of settling private scores or forcing parties into submission. It stressed that criminal law must not become a bargaining tool in private disputes after consuming public funds and valuable judicial time.
The judge noted that disputes that are essentially civil in nature may be considered for quashing of criminal proceedings following a settlement, provided the offences involved are not serious or against society at large.
The court also highlighted the burden that unnecessary criminal litigation places on the police and the judiciary, including investigation, evidence collection, court appearances and trial-related procedures.
As part of the order, Rizvi was directed to deposit Rs 25,000 with A K Munshi Yojana, a public charitable trust that runs medical centres, vocational training programmes and a special school for children with special needs.
The amount is to be paid within the stipulated period, and the matter has been scheduled for October 29, to verify compliance with the court's directions. The court has indicated that failure to fulfil the condition could result in the quashing order being recalled.
The order underlines the court's approach of allowing settlements in appropriate cases while ensuring that the criminal justice system is not unnecessarily burdened by disputes that can be resolved through other legal means.
